SUNSHINE COAST ELDER LAW offers fixed fees for clients entering into Contracts to purchase Homes in Manufactured Home Parks (usually referred to as Over 50s Resorts).
Our service is provided in two stages:
STAGE ONE – COMPREHENSIVE REVIEW AND ADVICE ON CONTRACTS
Our initial advice includes a comprehensive review of, and advice on the Manufactured Home Contract Documents (usually involving at least the Form 1 A Initial Disclosure Document, the Form 1 B Supplementary Disclosure Document, the Form 1 C Pre-Contractual Disclosure Waiver Document, the Form 2 Site Agreement and the Sale Contract with the Previous Owner, as well as often a series of additional ancillary documents) and encompasses:
An initial telephone discussion with you about the proposal.
A detailed review of the contract once provided to us.
A formal written advice to you about the contract documentation – outlining your rights and obligations.
Face to face meetings with you as needed to discuss the contract, highlighting any particular issues and concerns identified, and to answer any queries you raise.
Proceeding with signing of the documents and liaising with the solicitors/representative for the Park Operator and the Vendor about the Contract documents and moving towards settlement.
OUR FIXED COST: $750 + GST
STAGE TWO – COMPLETION OF SETTLEMENT FOR PURCHASE
Once the contract has been fully explained and considered, upon the decision being made to proceed we handle through to completion the conveyance to you of the interest being purchased in the Park, which includes:
Liaising with the Solicitors/Representative for the Park Operator and the Vendors in relation to arrangements for settlement.
Reviewing, and arranging for signing of all necessary documents.
Checking figures, and arrangements for payment.
Attending on settlement with the Solicitor/Representatives for the Operator and the Vendors.
Finalizing all necessary steps to ensure the tenure purchased in the Manufactured Home Park is formalized and secure.
OUR FIXED COST: $500 + GST
SALE OF YOUR OWN HOME
Most purchasers fund their purchase of their Manufactured Home by the sale of their own home.
We recommend we also act in that transaction, as the sale and purchase are best coordinated to occur at the same time, with payment from your sale being used to fund the purchase. Using the Pexa system for the sale means we can coordinate the sale and purchase to occur electronically, and simultaneously. Payments from the sale can be arranged to be provided by your purchaser which are then passed straight on to the Vendor of the Manufactured Home’s solicitors/representative, and those of the Operator, with any balance being banked into your personal account.
OUR FIXED FEE TO ACT IN THE SALE: $790 + GST
